      (a) Autoritatea contractantă are dreptul de a solicita ofertanților, în circumstanțe excepționale, înainte de expirarea perioadei de valabilitate a ofertei, prelungirea acestei perioade,

      (b) ofertantul are obligația de a comunica autorității contractante dacă este sau nu este de acord cu prelungirea perioadei de valabilitate a ofertei,

      (c) ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se consideră că și-a retras oferta, fără ca acest fapt să atragă pierderea garanției de participare.

      Limba de redactare a ofertei: Română.

      Toate certificatele și documentele emise în altă limbă decât română vor fi însoțite de traducerea autorizată a acestora în limba română.

      În cazul în care operatorii economici participanți la procedura de atribuire uzează de drepturile prevăzute la art. 193 din Legea 98/2016 prin completarea DUAE, documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE urmează a fi prezentate, la solicitarea autorității contractante, doar de către ofertantul clasat pe locul I.

      Solicitările de clarificări ale potențialilor ofertanți se vor adresa în mod exclusiv în SEAP la secțiunea „Întrebări” din cadrul procedurii de atribuire derulate prin mijloace electronice, iar răspunsurile la acestea vor fi publicate în SEAP, la secțiunea „Documentatie și Clarificări” din cadrul anunțului de participare, autoritatea contractantă urmand să nu dea curs solicitărilor adresate prin altă modalitate de comunicare decât cea stabilită în conformitate cu prevederile art. 64 alin. (1) din Legea nr. 98/2016 pentru comunicările ulterioare depunerii ofertelor. Comisia de evaluare va transmite solicitările de clarificare privind ofertele depuse, în SEAP la secțiunea „Întrebări”. Operatorii economici vor transmite răspunsurile la clarificări și eventualele documente solicitate pe parcursul evaluării ofertelor prin intermediul SEAP (secțiunea „Întrebări”), integral în secțiunea corespunzătoare respectivei solicitări, sub forma unuia sau a mai multor documente/fișiere distincte semnate cu semnătura electronică.

      În cazul în care se constată că ofertele clasate pe primul loc au prețuri egale, în vederea departajării ofertelor, autoritatea contractantă (prin intermediul SEAP la secțiunea „întrebări”) va solicita reofertarea, prin prezentarea unei noi propuneri financiare. Noua propunere financiară va fi depusă doar și numai în urma solicitării autorității contractante.

      Ofertantul va prezenta o declarație prin care acceptă clauzele contractuale cuprinse în modelul de contract din documentația de atribuire. În situația în care sunt obiecțiuni la proiectul de contract, respectiv modificări ale clauzelor contractuale sau adăugarea unor clauze noi, eventualele propuneri de modificare/completare/eliminare de clauze contractuale vor fi formulate în scris cu justificări și înaintate cu documentele de calificare. Dacă propunerile sunt dezavantajoase pentru AC, aceasta își rezervă dreptul de a le respinge informând ofertantul.

      Dacă ofertantul nu renunță la aceste clauze, AC va încadra oferta ca neconformă și o va respinge.

      Pentru accesul la datele de identificare ale participanților la procedură, se va completa DUAE.
