      Avand in vedere ca autoritatea contractanta va semna acordul cadru doar cu operatorii ecomomici situati pe locul I, II, III,dupa caz, modul de departajare a ofertelor cu preturi egale se va face astfel:

      1. In cazul in care comisia constata ca au fost depuse/introduse in SEAP mai mult de doua oferte admisibile cu preturi egale la ofertantii clasati pe locul 1, autoritatea contractanta va transmite prin SEAP, o solicitare de clarificare referitoare la depunerea unor noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SEAP, caz in care contractul va fi atribuit primilor 3 ofertanti care au pretul cel mai scazut. În cazul pastrarii egalitatii si dupa solicitarea de clarificare referitoare la depunerea unor noi propuneri financiare imbunatatite in SEAP, procedura de atribuire pentru lotul respectiv se anuleaza.

      2. In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cu preturi egale de catre ofertantii clasati pe locul II, modul de departajare a acestora se va face prin solicitarea, in SEAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SEAP, astfel incat ofertantul clasat pe locul I sa nu fie afectat, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul I. În cazul în care noua propunere financiara imbunatatita depusa in SEAP ca urmare a solicitarii autoritatii contractante primite prin va influenta clasamentul locurilor superioare, aceasta nu va fi luata în considerare, pastrându-se oferta initiala depusa in SEAP, la procedura.

      3. In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cu preturi egale de catre ofertantii clasati pe locul III, modul de departajare a acestora se va face prin solicitarea in SEAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SEAP, astfel incat ofertantii clasati pe locul I si II sa nu fie afectati, respectiv noua propunere financiara sa nu fie egala sau mai mica decat oferta clasata pe locul I respectiv II. În cazul în care noua propunere financiara imbunatatita depusa in SEAP ca urmare a solicitarii autoritatii contractante va influenta clasamentul locurilor I si II, aceasta nu va fi luata în considerare, pastrându-se oferta initiala depusa in SEAP, la procedura. Termenele/datele de depunere ale noilor propuneri financiare se vor comunica în solicitarea transmisa de catre autoritatea contractanta. Fara a aduce atingere prevederilor Legii nr.182/2002 privind protectia informatiilor clasificate, cu modificarile si completarile ulterioare, operatorul economic va preciza in oferta depusa acele informatii cuprinse in propunerea tehnica si in propunerea financiara considerate a fi confidentiale, clasificate, protejate de un drept de proprietate intelectuala in masura in care, in mod obiectiv, dezvaluirea acestor informatii ar prejudicia interesele legitime ale operatorului economic, in special in ceea ce priveste secretul comercial si proprietatea intelectuala. Autoritatea contractanta va incheia contracte subsecvente cu operatorul economic clasat pe locul I pana cand acesta isi declara incapacitatea de a mai furniza produsele sau se reziliaza acordul cadru cu acesta. In acesta situatie autoritatea contractanta va incheia contracte subsecvente cu operatorul economic clasta pe locu II sau III daca cel clasat pe locul II refuza semnarea contractului subsecvent.
